Visa description
Many people become permanent residents through a job or employment offer. Some categories require certification from the U.S. Department of Labor demonstrating that there are not enough capable, willing, qualified, and available U.S. workers in the geographic area in which the immigrant is to be employed and that no U.S. workers are displaced by workers. foreign. In other cases, highly skilled workers, those with extraordinary ability in certain professions, and investors/entrepreneurs are given priority to immigrate through various immigrant categories. Apply for the Green Card
You may be eligible to become a permanent resident based on an offer of permanent employment in the United States. Most categories require an employer to obtain a labor certification and then file a Form I-140, Immigrant Petition for Foreign Worker, for you.
The Green Card may be available to investors/entrepreneurs who are making an investment in a company that creates new jobs in the United States.
Some categories of immigrants allow you to file your own application (“self-petition”). This option is available to “aliens with extraordinary abilities” or to certain individuals who have been granted a national interest waiver.
SPECIAL EMPLOYMENT CATEGORIES
For your permanent residence
There are a number of specialized jobs that may allow you to obtain a Green Card based on your current or past employment. All of them require a Form I-360, Petition for Amerasian, Widow(er) or Special Immigrant, and it is described in Section 101(a)(27) of the Immigration and Nationality Act (INA).

In some cases, you may be able to file the immigrant petition (either Form I-140 or I-360 depending on your category) at the same time as filing Form I-485, known as “simultaneous filing.”
If you are not eligible to adjust your status within the United States to a permanent resident, the immigrant petition will be sent to the United States consulate abroad to complete the visa process. To apply for a green card, a visa must be immediately available to you.
