Ways to obtain citizenship
Processing and obtaining American citizenship is one of the most important decisions of an immigrant. Depending on each situation, there are different ways for an individual born in another country to become an American citizen.
A foreign citizen can obtain American citizenship by acquisition, that is, when it is obtained from American parents at birth or after being born, but before reaching the age of 18. And you can also obtain it through naturalization, that is, after turning 18 years of age and after having met the requirements established by the United States Congress in the Immigration and Nationality Law.
Who obtains American citizenship by acquisition:
- People who are born abroad as children of US citizens.
- Foreign-born persons who were under 18 years of age and permanent residents when one or both of their parents naturalized, or after adoption by a parent who is a U.S. citizen.
- To request an original certificate of citizenship, form N-600 must be completed.
Who is eligible to obtain American citizenship through the naturalization process:
In order to be eligible for naturalization, certain requirements required by US immigration law must be met, the general requirements are mentioned below:
- Be at least 18 years of age.
- Prove that you are a permanent resident legally admitted to the United States for at least 5 years (or 3 years if married to a US citizen).
- Have resided in the United States as a lawful permanent resident for a minimum of five years (or 3 years if married to a U.S. citizen), immediately prior to the date of filing Form N-400.
- Have been physically present in the United States for at least 30 months immediately before the date of filing Form N-400.
- Demonstrate that you are a person of good moral character and have been for at least five years, immediately prior to the date of filing Form N-400.
- Be able to speak, read, write and understand English.
- Have knowledge of the fundamentals of the history, principles and form of the United States government.
- Demonstrate adherence to the principles of the Constitution, good disposition for the good order and well-being of the United States.
- Be willing and able to take the Oath of Allegiance.
STEPS
How is naturalization processed?
To apply for naturalization, the first thing you must do is check if you are eligible, that is, if you meet the general requirements mentioned above.
Once your eligibility has been verified, you must complete and submit Form N-400 to USCIS along with documents that demonstrate that you meet the general conditions to obtain American citizenship.
After you have submitted the N400 USCIS form, you will be notified of the date and time of your appointment to take your biometric data (photos and fingerprints).
The next step is to show up for the interview appointment. During your interview you must pass an exam given by an officer from the United States Citizenship and Immigration Services. The exam consists of two parts: civics test and English test.
After your interview and passing your citizenship exam, you will be notified to attend the oath ceremony.
Once sworn in, you can process and obtain your American passport.
